Please read these Terms of Service carefully before using the Kastly app or website. By downloading, installing, or using the Service, you agree to be bound by these terms. If you do not agree, do not use the Service.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Kastly ("we", "us", or "our") governing your use of the Kastly mobile application and website (collectively, the "Service").
You must be at least 13 years old to use the Service. By using it, you represent that you meet this requirement.
Kastly is a fishing trip logging application that provides GPS route tracking, catch logging, species information, offline mapping, regulatory zone information, and cloud synchronization features. The Service is available in free and paid (Pro) tiers.
To access certain features, you must create an account. You are responsible for:
You may not share your account with others or use another person's account. We reserve the right to suspend or terminate accounts that violate these Terms.
The free tier of Kastly is available at no cost and includes up to 5 trips per month, 10 catches per trip, and access to 20 common species.
The Pro subscription unlocks unlimited trips and catches, the full species database, analytics, offline maps, and regulatory zone alerts. Pro is available as a monthly or annual subscription.
All Pro subscriptions are billed through the Apple App Store. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Payment is charged to your Apple ID account at confirmation of purchase.
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you retain access to Pro features until then. We do not offer refunds for partial subscription periods except as required by law or as determined by Apple.
We may change subscription prices at any time. Price changes will take effect at the start of the next renewal period. We will notify you of any price change in advance.
You retain ownership of the trip data, catch logs, and other content you create in Kastly ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.
You are responsible for ensuring that any content you enter (including species data, locations, and notes) is accurate and does not violate any applicable laws.

Kastly provides regulatory zone information (open/restricted/closed areas) as a convenience feature based on publicly available data. This information is provided for informational purposes only and may not reflect current regulations. You are solely responsible for verifying applicable fishing regulations with the relevant authorities before fishing. Kastly is not liable for any regulatory violations resulting from reliance on in-app zone information.
The Service, including the app design, code, logos, and content (excluding User Content), is owned by Kastly and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KASTLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) €10.
You agree to indemnify and hold harmless Kastly and its affiliates from and against any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, through in-app notifications. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 10, 11, and 14 of these Terms survive termination.
These Terms are governed by the laws of Poland, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Poland.
If you are a consumer in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
